Over the past several years, quite a few jurisdictions have started to require age assurance for access to various forms of content and experiences. In most current cases, this amounts to a mandate on the service (PornHub, Facebook, etc.), but understandably this isn't popular with services, who have in some cases been advocating to move requirements from the service to the device. A number of jurisdictions have recently passed legislation requiring device-based age assurance, including California AB 1043, Texas SB2420, and Utah SB 142. While device-based age assurance can be made to work and has some technical advantages, actually writing requirements that don't undesirable side effects is a lot harder than it looks, as we'll be seeing in the remainder of this post.
